Terms of Service

The rules and responsibilities that apply when using the Friendever app, website, content, and related services.

These Terms of Service (the “Terms”) are a legal agreement between you and Friendever LLC (“Friendever,” “we,” “us,” or “our”). They govern your access to and use of the Friendever mobile application, website, content, features, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who May Use Friendever

You must be at least 16 years old to create and manage a Friendever account. If you are under the age of legal majority where you live, you represent that you have permission from your parent or legal guardian to use the Service and agree to these Terms.

Children do not create independent Friendever accounts. An eligible account holder may create child profiles and use the Service with children under that account holder’s supervision. Children may use Friendever’s child-focused content only through an account created and supervised by an eligible parent, legal guardian, or authorized caregiver. By creating a child profile or submitting information about a child, you represent that you are the child’s parent, legal guardian, or otherwise have lawful authority and any required consent to do so.

2. What Friendever Provides

Friendever is a parent-led family platform that may include emotional-learning content, affirmations, character-led lessons, music, parent guidance, journaling tools, and private family memory-storage features.

Important: Friendever provides educational and general wellness content. It is not medical, psychological, psychiatric, therapeutic, diagnostic, or emergency advice and is not a substitute for care from a qualified professional. If you believe a child or another person may be in immediate danger, contact local emergency services.

3. Accounts and Account Security

You agree to provide accurate information, keep your login credentials confidential, and promptly update information that changes. You are responsible for activity conducted through your account, including activity by anyone you permit to use it.

Notify us promptly at support@friendever.com if you believe your account has been accessed without authorization.

4. Parent and Caregiver Responsibilities

You are responsible for deciding whether the Service and any particular content are appropriate for your child or family. You agree to supervise children while they use or participate in the Service and to review content before relying on it for parenting, education, or wellness decisions.

You are also responsible for ensuring that any information, photographs, videos, names, dates, or other material you add concerning a child is submitted lawfully and with all required permissions.

5. Your Content and the Memory Vault

“Your Content” means photographs, videos, written memories, journal entries, profile information, and other material you upload or submit to the Service.

You retain ownership of Your Content. You grant Friendever a limited, non-exclusive, worldwide license to host, store, reproduce, process, display, and transmit Your Content only as reasonably necessary to operate, secure, maintain, and improve the Service and provide it to you.

You represent that you own Your Content or have the rights and permissions necessary to upload and use it. You must not upload content that:

Friendever may remove or restrict content when reasonably necessary to protect users, enforce these Terms, comply with law, or protect the Service.

You may use the Service only for lawful, personal, and family purposes. You may not:

7. Friendever Content and Intellectual Property

The Service and all content provided by Friendever—including characters, lessons, affirmations, songs, videos, artwork, designs, text, software, logos, trademarks, and branding—are owned by Friendever or its licensors and are protected by intellectual-property laws.

Subject to these Terms, Friendever grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended family and educational purposes. No ownership rights are transferred to you.

8. Purchases, Subscriptions, and Paid Features

Some features may be free, while others may be offered through purchases or subscriptions. Before completing a purchase, you will be shown the applicable price, billing period, and material terms.

Purchases made through Apple’s App Store or Google Play are processed by the applicable store and are also subject to that store’s payment, renewal, cancellation, and refund terms. Unless required by law, Friendever does not control refunds processed by an app store.

If auto-renewing subscriptions are offered, they will continue until canceled through the applicable app-store account settings. Removing the app does not by itself cancel a subscription.

9. Third-Party Services and App Stores

The Service may rely on or link to third-party providers, platforms, app stores, or websites. Their services are governed by their own terms and privacy practices. Friendever is not responsible for third-party services that it does not control.

When you download the app from Apple’s App Store or Google Play, the applicable store’s terms also apply. If those terms conflict with these Terms regarding your use of the store, the store terms control for that issue.

11. Service Changes and Availability

We may add, modify, suspend, or discontinue features as the Service evolves. We do not guarantee that every feature will always be available, uninterrupted, error-free, or compatible with every device. We may perform maintenance or make changes for security, legal, technical, or business reasons.

12. Account Suspension and Termination

You may stop using the Service at any time and may request account deletion through the app or as described on our Contact & Support page.

We may suspend or terminate access when we reasonably believe an account violates these Terms, creates risk or harm, is used unlawfully, threatens the security of the Service, or must be restricted to comply with law. Where appropriate, we will attempt to provide notice.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Friendever disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability.

We do not guarantee particular educational, emotional, behavioral, developmental, parenting, health, or family outcomes from use of the Service.

14. Limitation of Liability

To the fullest extent permitted by law, Friendever LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from or related to the Service.

To the fullest extent permitted by law, Friendever’s total liability for all claims arising from or related to the Service will not exceed the greater of (a) the amount you paid Friendever during the twelve months before the event giving rise to the claim or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Friendever LLC and its owners, officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, and expenses arising from your unlawful use of the Service, Your Content, your violation of these Terms, or your violation of another person’s rights.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Missouri, and you consent to their jurisdiction.

17. Changes to These Terms

We may update these Terms as the Service, law, or our practices change. We will post the revised Terms and update the “Last updated” date. If a change materially affects your rights, we may provide additional notice through the Service or by email. Continued use after the effective date of revised Terms means you accept them.

18. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written permission. We may assign these Terms as part of a merger, financing, reorganization, sale of assets, or similar transaction.

These Terms, together with the Privacy Policy and any additional terms presented for a specific feature, constitute the entire agreement between you and Friendever regarding the Service.
